Pago Pago, AMERICAN SAMOA — The two probationers who tested positive for drugs last Thursday have been ordered to each serve 9 days at the Territorial Correctional Facility (TCF).

Ieniseli Mosese and Faafetai Lefatia Jr appeared before Judge Elvis P. Patea yesterday morning for a Disposition Hearing. Assistant Public Defender Ryan Anderson represented both defendants, while Assistant Attorney General Jason Mitchell prosecuted on behalf of the government.

Patea said that according to court records, Mosese has two criminal cases.

In her first case, she was sentenced to 12 months on Dec. 11, 2018 under the condition that she serve 10 days at the TCF. She was credited for the one day she served, and the court suspended the remaining 9 days of detention.

A few months later in May of this year, while still on probation, Mosese appeared in court for a probation revocation hearing, where the court did not revoke probation but instead, modified it.

Last Thursday, Mosese was sentenced for a second case, whereby she was placed on probation for 6 months under the condition that she serve 10 days at the TCF. She was credited for the one day she served at the TCF, and the court suspended the remaining 9 days.

That same day, Mosese tested positive for meth. (See separate story for details).

After reviewing the defendant’s file, Patea said the court will give Mosese one last chance to prove herself. Patea ordered her to serve the two suspended periods of detention (9 days). The two will run concurrently, which means, she will only serve 9 days at the TCF.

“Mosese, you have to remember that you’re running out of options from this court. If you come back for another violation, the court will revoke your probation,” Patea told the defendant.

Mosese is scheduled to be released from the TCF this Saturday at 1:00p.m.

LEFATIA

The court also gave Lefatia one more chance, when he appeared for a Disposition Hearing yesterday morning.

Lefatia is on probation for three separate cases. After reviewing his files, Patea said the court will not revoke the defendant’s probation but instead, modify it.

The court vacated the suspended detention period of 9 days for Lefatia and ordered him to serve it out.

According to Patea, Lefatia was sentenced to 12 months probation last month and was ordered to remain alcohol and drug free. Lefatia tested positive for marijuana when he stopped by the Probation office last Thursday morning for his monthly visits.
