District Court grants permission for defendant to travel off island

Pago Pago, AMERICAN SAMOA — The court has granted permission for defendant Faamalologa Eniata a.k.a. Malologa Leulu to travel off island to attend family matters. Travel dates are April 7-11

Eniata appeared in court Thursday morning for two separate cases. The first case includes charges of third degree assault and public peace disturbance, for an incident that occurred in 2017. Judge Pro Tem Gwen Tauiliili-Langkilde has set that matter for May 9th.

The more recent case against Eniata charges him with sodomy, two counts of first degree sexual abuse, and endangering the welfare of a child for alleged sexual acts committed against an 11-year-old minor.

For that case, Eniata waived his right to a preliminary examination and his case has been bound over to High Court where he was expected to enter 'not guilty' pleas to the charges against him, during arraignment this past Friday.

ELISARA FATA a.k.a. ELISARA FATULOLE a.k.a. ESERA LOLE

An overstayer who pled guilty to public peace disturbance is ordered to head back to Samoa no later than today, and he is to remain outside of the territory for 24 months, the duration of his court ordered probation.

Elisara Fata, a.k.a. Elisara Fatulole, a.k.a. Esera Lole appeared in District Court yesterday morning for a status hearing. According to Immigration Fata entered the territory on a 30-day permit on March 5, 2019.

Information revealed in court states that Fata was involved in an incident on March 30, 2019 whereby he disturbed the peace by shouting profanities and acting unruly.

In rendering sentence, Judge Pro Tem Gwen Tauiliili-Langkilde made it clear to Fata that he is to be enroute to Samoa no later than today, and if he re-enters the territory within the next 24 months, he is to immediately visit the Probation Office.
