Another random drug test, another arrest for Iosefo N. Sagote

Pago Pago, AMERICAN SAMOA — A man who has a pending criminal case in High Court for unlawful possession of illegal drugs was arrested again last Friday, after testing positive for methamphetamine.

The man, Iosefo N. Sagote will appear in High Court this morning for his initial appearance for alleged failure to comply with a condition of his release, where he was ordered to stay clean from illegal drugs and alcohol.

Sagote was in court last Friday for his pretrial conference. He’s represented by private attorney Marcellus T. Uiagalelei, while assistant attorney general, Woodrow Pengelly is prosecuting the case.

When his case was called, his attorney informed the court that they received discovery from the government, and they need 30 days to review all the discovery.

“Do you need that much [time]?” Chief Justice Michael Kruse asked Uiagalelei. His response was, given the nature of the case, they need to interview some witnesses before determining what to do next.

Kruse said that except for the one sex case, which was in front of the court last Friday, all other cases were drug related cases.

Sagote, who is out on surety bond is scheduled to appear in court for another pretrial conference on July 6.

As a condition of his release, Sagote has to submit himself for random drug & alcohol testing.

Immediately after his hearing last Friday, the defendant was ordered by the Probation Officer to take a drug test. As a result, Sagote allegedly tested positive for methamphetamine, and he was immediately arrested and transported back to the Territorial Correctional Facility (TCF) to await his initial appearance in High Court this morning for a probation revocation hearing.
