Two probationers back in custody after testing positive for drugs

Pago Pago, AMERICAN SAMOA — Two probationers made their appearance in court last Friday morning on the allegations that they violated conditions of their probation, after testing positive for drugs.

Faafetai Lefatia Jr and Eniselina Mosese appeared before Judge Elvis P. Patea for an Order to Show Cause (OSC) hearing. Both defendants were represented by Assistant Public Defender Ryan Anderson, while prosecuting was Assistant Attorney General Jason Mitchell.

Both Lefatia Jr and Mosese are on 12-month probation after being convicted of public peace disturbance. Among other things, both defendants were ordered to remain alcohol and  drug free, and make monthly visits to the Probation Office.

Last Thursday afternoon, both Lefatia Jr and Mosese visited Probation, and a random urinalysis was carried out. (Random drug testing is a condition set by the court for people sentenced to probation, to ensure they are clean).

Lefatia Jr tested positive for marijuana while Mosese tested positive for meth.

When the cases were called in court, both defendants waived their rights to a preliminary hearing, and admitted to the violations.

A disposition hearing for the pair — both still in custody — is this morning.
