Pago Pago, AMERICAN SAMOA — The 25 year-old man convicted of stealing a pair of laptops from a Malaeimi home has been given a chance by the court.

Filo Fuimaono appeared in court last week for sentencing. He was initially charged with second degree robbery and stealing; however, under a plea agreement, he pled guilty to stealing, a class C felony.

When given the chance to address the court, Fuimaono, who has been in custody since his arrest last year, apologized and begged for a chance to return home to care for his parents. He also apologized to the victim.

Defense attorney Rob McNeill asked the court to sentence his client to probation, without any additional period of detention. He said his client is truly remorseful and has learned a good lesson.

Prosecutor Doug Lowe echoed McNeill’s submission and told the court the government believes Fuimaono is truly remorseful.

Fuimaono was sentenced to 7 years imprisonment. Execution of sentence is suspended and he is placed on probation for 7 years subject to certain conditions. He has to serve 28 months at the TCF; however, 8 months is stayed - based on good behavior - and he will only serve 12 months.

According to court records, the completion of the defendant’s 12-month detention period will expire at the end of this month. Fuimaono is also ordered to remain law abiding; visit Probation once a month; and find a job.
