Jealousy allegedly causes brothers to disturb the peace of neighbors

Pago Pago, AMERICAN SAMOA — On November 7, 2024, a male individual contacted the Tafuna Police Substation (TPS) to report an alleged disturbance caused by his brother because he was jealous over a girl.

The suspect was later apprehended after fleeing the scene twice and was later charged with Count 1: Private Peace Disturbance (DV), a class C misdemeanor punishable by imprisonment for up to fifteen days, a fine of $300 but not less than $150, or both.

The defendant’s bail was set at $1,000.

According to the affidavit, on November 7th, at about 8:48 p.m., a male individual called the TPS to report that his brother was allegedly causing a disturbance at his residence.

Police officers responded to the call and upon arrival at the scene, they met up with the male individual (victim) who reported the disturbance. The victim informed the officers that his brother had fled the scene after throwing a beer bottle at his bedroom window.

According to the victim’s verbal statement, his brother (suspect) came to his house and started yelling at him. The suspect accused him of talking to his girlfriend. The victim stated that he locked himself inside the house because he was afraid that his brother, Allan Sivanu, might hurt him.

The victim further stated that Allan was outside the house yelling out profanities in Samoan at him and told him to open the door. The victim stated he was inside his bedroom and was shocked when a loud noise of shattered glass and then a beer bottle flew inside his bedroom.

The victim explained that by the time he got out of the room, the suspect had already left the scene and that’s when he contacted the TPS for help.

At about 9:27 p.m., the officers completed canvassing the victim’s residence and area. The officers advised the victim to call the TPS if the suspect came back home.

At about 10:40 p.m., the victim contacted the TPS again and reported that the suspect came back to the house and threw a rock at the other side of his bedroom window and damaged his TV, PS4 and shattered the top louvers.

The officers responded again to the disturbance and while proceeding they contacted the victim, and the victim stated that the suspect had left the scene again and had seen him running towards the neighbor’s house across the road.

Upon arrival at the scene, the officers proceeded to the neighbor’s house where they asked two teenagers hanging out by the road if they had seen the suspect run down from their house into the neighbor’s house. The teenagers stated that a grey truck picked up the suspect a few minutes before they arrived and that the car headed towards the end of the road.

Officers canvassed the area up to the end of the road and didn’t see a gray truck. The officers proceeded to the cattle pen in A’asu to check if they had seen the gray truck.

Upon approaching the cattle pen, a vehicle was observed from afar, and the closer they got to the vehicle the more it moved towards them. Upon reaching the vehicle, Allan was observed getting out of it and taking off.

The officers chased him on foot and he was apprehended.

The suspect was Mirandized and agreed to make a statement.

He agreed to everything that was reported by the victim.

The suspect was booked and confined at the Tafuna Correctional Facility to await the next available sitting of the District Court.

The defendant is identified as a 24-year-old U.S National.
