Count 1: Private Peace Disturbance (DV), a class C misdemeanor punishable by imprisonment for up to fifteen days, a fine of $300, or both imprisonment and fine; and,
Count 2: Assault in the Third Degree (DV) (As a class C Misd.), a class C misdemeanor punishable by imprisonment for up to fifteen days, a fine of $300, or both.
The defendant was held without bail.
Court records indicated that on Aug. 20th, at around 3:07 p.m., a woman (the victim) called and reported her brother (the suspect) was causing a disturbance at their home in Malaeloa.
Authorities responded to the call and, upon arrival at the scene, met with the victim, who explained what had happened.
According to the victim, she walked over to their late mother’s house, where the suspect now resides, and she put up pictures of their parents on the wall. While there, she heard the suspect talking to her older brother off-island on the phone.
The victim said she heard her brother from off-island advising the suspect that he needed to stop causing trouble with his sister. The suspect became angry, hung up the phone, and told her to leave the house.
The suspect was furious, and he stood up and yelled profanities at her and told her to get out of the house while she was on a 4- 5-foot folding ladder.
The suspect continued to threaten her multiple times and told her to get out or he would burn her house down and kill her. The suspect walked towards her, attempting to hit her with a broom handle, but fortunately, the suspect’s daughter intervened and stopped him. The suspect swung at her but was unable to reach her because his daughter was in his way.
The victim explained that she was able to walk away and called the police for assistance.
She also informed the officers that this is not the first time that the suspect had threatened to burn her house down and kill her. She stated that she doesn’t feel safe anymore and was traumatized by what their older brother did to her five years ago.
The victim explained that five years ago her older brother had threatened to kill her and her husband. The threat led to her husband being hospitalized and on a feeding tube until now. The victim still felt vulnerable and terrified that the suspect would do the same to her.
After speaking with the victim, the officers spoke with the suspect at his residence, where he told the officers that “he was very mad at his sister for telling their older brother things that are happening to them.” He then yelled at her and chased her out of the house. He admitted that he was infuriated with the victim, and he grabbed a broom and dust pan to hit her, but his daughter got in the way and stopped him.
The suspect’s daughter was also interviewed, and she told the officers that she did not know what happened until she heard her dad yelling at her aunt, and she came and tried to calm her dad down.
The suspect was apprehended and transported to the LPS for further investigation.
The suspect was later booked and confined at the Tafuna Correctional Facility to await the next available sitting of the District Court.
The defendant is identified as a 66-year-old U.S. national.
