Overstayer who had sex with 15-yr-old in Mesepa pleads guilty to sexual abuse

Pago Pago, AMERICAN SAMOA — A 28-year-old man from Mesepa accused of having sex with a 15-year-old girl multiple times has entered into a plea agreement with the government.

Alfred Aliivaa appeared in High Court last week for a Change of Plea hearing. He was represented by Public Defender Michael White, while prosecuting was Assistant Attorney General Laura Garvey.

Aliiva’a, who has remained in custody unable to post a surety bond of $10,000 was initially charged with two counts of rape and two counts of sodomy, both class B felonies; four counts of first degree sexual abuse, a class D felony; and two counts of endangering the welfare of a child, a class A misdemeanor.

But under a plea agreement with the government, Aliiva’a pled guilty to two counts of first degree of sexual abuse. The remaining charges are dismissed.

Both parties have recommended to the court that Aliiva’a be placed on probation for 5 years under the condition that he register as a sex offender and undergo HIV testing before he departs the territory and remains outside of its borders.

According to terms of the plea agreement, Aliiva’a admits that on April 1 and June 30, 2018, he touched the private parts of a 15-year-old girl to gratify his sexual urges.

It was a member of the victim’s family who reported the incident to police.

When investigators interviewed the victim, she told them she had sexual intercourse with the defendant about six times, and she met Aliivaa when she spent the night with her aunty at her home in Mesepa.

The victim also told police that Aliivaa gave her money after she had sex with him.

Aliiva’a, an overstayer, will be sentenced Aug. 2
