Man enters plea in assault case involving a shovel

Pago Pago, AMERICAN SAMOA — Frank Amosa accused of assaulting another person has entered into a plea agreement with the government two weeks ago in High Court.

Amosa was initially charged with resisting arrest and second degree assault, both felonies; and three 3 misdemeanors: two counts of third degree assault, and public peace disturbance.

Under a plea agreement with the government, Amosa pled guilty to second-degree assault, a class D felony, punishable by up to 5 years imprisonment, a fine of up to $5,000 or both.

Amosa admits that on Mar. 12th, 2020 in Tafuna he assaulted a man by striking his head and body with a shovel. According to terms of the plea agreement, on the day of the incident, police responded to a call from someone in the Tafuna area, regarding a disturbance.

When cops arrived, an unknown male who was later identified as Amosa was holding a shovel while two other male individuals tried to hold him back. Cops also observed another group of people in the same area trying to offer assistance to another male individual who was sitting on the ground.

Cops observed blood coming from the head of the male sitting on the ground. He was later identified as the victim in this case.

Several eye-witnesses told police that they were doing construction work for the church minister’s family when the fight between the two men broke out. Amosa approached the victim about something and a verbal argument started.

Two witnesses stated that the victim apologized to Amosa on behalf of his son’s action for stealing tools from Amosa’s house. Amosa remained angry and pushed the victim away. He then turned around and grabbed a shovel and immediately struck the victim on his head twice,  causing the victim to fall to the ground. Amosa then stuck the victim again on his back multiple times while the victim was still on the ground.

Amosa is scheduled to appear in court next month for sentencing.
