Charges lodged after cousin allegedly assaults his female cousin
Pago Pago, AMERICAN SAMOA — On September 22, 2024, a female individual contacted the Tafuna Police Substation (TPS) to report an alleged assault by her cousin who was also causing a disturbance in their home.
The suspect was apprehended and later charged with:
Count 1: Private Peace Disturbance (DV), a class C misdemeanor punishable by imprisonment for up to fifteen days, a fine of $300, or both; and,
Count 2: Assault in the Third Degree ( As a C Miscd.) (DV), a class C misdemeanor punishable by imprisonment for up to fifteen days, a fine of $300, or both.
The defendant’s bail was set at $1,000.
According to the affidavit, on September 22nd, at approximately 1:52 p.m., a female individual (later identified as complainant and victim #1) contacted the TPS for assistance. She alleged that her cousin, Fidelis Taumalua (suspect) was causing a disturbance at their home by repeatedly shouting profanities in Samoan at her and her mother, and was also being disrespectful to other family members, as well.
At around 2:00 p.m., police officers responded to the call and upon arrival met up with victim #1. The victim invited the officers inside and directed them to the suspect’s location. The suspect was found in his room, where he was apprehended and placed inside the police unit. Authorities then conducted an interview with victim #1.
According to victim #1, she and her family returned from church and had an afternoon meal. The suspect became upset because no food was left for him and began yelling profanities. When she inquired about the problem, the suspect turned towards her and attempted to punch her but she walked away, avoiding the blow.
She further explained that her family members felt frightened as the suspect pounded on his door, damaging it, and broke dishes stored in a cabinet. He also entered his aunt’s room, demanding to know why no food had been left for him.
Victim #1 added that the suspect had a history of disrespectful behavior.
Police officers observed what appeared to be knuckle-shaped holes on the damaged door.
The suspect’s girlfriend (victim #2) was also interviewed. She told police that during the incident, the suspect also attempted to hit her with a broom. Both the suspect's mother and aunt confirmed the statements made by both victims.
Following the investigation, the suspect was transported to TPS and upon arrival he was Mirandized and refused to make a statement.
The suspect was booked and confined at the Tafuna Correctional Facility awaiting the next available sitting of the District Court.
The defendant is identified as a 32-year-old U.S National.
