Pago Pago, AMERICAN SAMOA — A man has been charged with one count each of third degree assault and public peace disturbance, both misdemeanors, for allegedly assaulting the mother of his children at their Fagatogo home.

The man is alleged to have been intoxicated when the incident occurred.

To protect the victim, Samoa News is withholding the names of all parties involved.

The defendant was released on his own recognizance, but the court has ordered that he make no contact with the victim and find a place to stay while his case is pending.

Court information states that when police arrived at the scene, the defendant rushed to the officers and told them that “his wife was having an affair” with a co-worker.

According to information revealed in court, the victim and the defendant are not legally married, but they have been living together for 11 years and they have 4 young children.

The alleged assault resulted in the victim suffering a cut above her left eye and she was taken by EMS to LBJ Medical Center for treatment.

There are different stories from both parties, of exactly how the assault went down.

The victim told police that the defendant punched her in the left eye with his fist.

But according to the defendant's statement to police, he slapped the victim with an open hand and the victim was wearing sunglasses, which is what caused the cut above her left eye.

The defendant told police that he was suspicious of the victim “cheating on him” and that's what made him slap her.

Court records reveal that the defendant was convicted of third degree assault back in 2013. In that incident, the defendant assaulted another man during a drinking session with friends at Utulei Beach.
