Pago Pago, AMERICAN SAMOA — A man who failed to do what the court ordered him to do, is now back in custody at the Territorial Correctional Facility with bail set at $500 cash.

Asofa Titio Sr made his initial appearance in District Court yesterday morning on the charges of criminal contempt and public peace disturbance.

He is represented by Assistant Public Defender Ryan Anderson while prosecuting for the government is Assistant Attorney General Laura Garvey.

According to the government's case, police got a call for assistance last Saturday, Mar. 16 regarding an incident in the Nuuuli area.

Titio Sr was allegedly intoxicated and causing a disturbance by yelling profanities at his wife in front of family members and their kids.

Titio Sr is said to have been drinking next to his home, and lots of kids were playing in the area.

While the defendant's wife was speaking to the responding officers, cops say Titio Sr was mouthing off, asking his wife if this is what she wanted. He continued to yell at her in front of the cops and that's when he was placed in a police unit for transport to the police station.

Samoa News understands that Ttito Sr was playing bingo and drinking at the same time. He allegedly asked his wife for money and when she said "there was none", he became angry and started cussing at her.

According to police, Titio Sr reeked of alcohol when they took him in. His speech was slurred and his eyes were blood shot red.

Titio Sr has a pending matter in District Court.

His next court appearance for the new case is set for Apr. 24.

He has entered "not guilty' pleas to the new charges and despite a request from his attorney to release him on his own recognizance, Judge Elvis P. Patea has maintained bond at $500 cash for both cases.

According to the judge, the criminal contempt charge against Titio Sr is an indication that the defendant doesn't want to do what he's supposed to, as ordered by the court.

Judge Patea noted that Titio Sr failed to appear in court on Oct. 18, 2018.

If he is able to post bond, Titio Sr is ordered to be law abiding, not leave or attempt to leave the territory without prior permission of the court, remain sober, and he is subject to random testing.
