Female on probation for stealing — arrested for drugs

Pago Pago, AMERICAN SAMOA — A female probationer was arrested and taken into custody two weeks ago.

Luisa “ISA” Allan made her initial appearance before District Court Judge Elvis P. Patea and bond is set at $5,000. She is charged with one count each of unlawful possession of methamphetamine; and unlawful possession of marijuana - both felonies punishable by imprisonment between 5-10 years; a fine between $5,000-$20,000 or both.

If she is able to post bond, Allan is to remain law abiding, not leave or attempt to leave the territory, and not make any direct or indirect contact with the government’s witnesses.

Allan was arrested two weeks ago on the allegation that she disturbed the public peace (PPD). She was taken in for questioning and later escorted to the TCF where she was patted down and a glass pipe containing a white crystalline substance fell from her pants. (The white crystalline substance tested positive for meth).

TCF guards also found a small baggie containing a green leafy substance in the left pocket of Allan’s pants. (The green leafy substance tested positive for marijuana).

When asked about the glass pipe, Allan told police it was given to her by a friend. She said she hid the drugs when police searched her at the Tafuna Substation because she’s on probation for a stealing conviction from last year.

Allan was taken back to the Tafuna Substation for a second interview, during which she told police that she got the drugs from a friend, but she doesn’t smoke meth.

BACKGROUND

Allan was convicted of felony stealing in February 2018 and subsequently sentenced to 5 years probation under the condition that she serve 10 months at the TCF.

However, she was given a huge break by the court when she was credited for the 6 months she served in pretrial confinement; the remaining 4 months was stayed, as long as she complied with all conditions of probation. She was also ordered to pay a $500 fine within 10 months, and find a job.
