Police apprehend a suspect while he was carrying his daughter

Pago Pago, AMERICAN SAMOA — A man who was apprehended by police after he allegedly disturbed the peace in his neighborhood last Saturday has been charged with three misdemeanors.

Alapati Vaivai made his initial appearance in District Court this past Monday, where he denied the charges against him. The charges include third degree assault, public peace disturbance, and endangering the welfare of a child.

He has been released on his own recognizance by Judge Fiti Sunia subject to the condition that he is not to possess or consume any alcoholic beverages; he is to maintain the peace at his home and his village; and he is ordered to make all his scheduled court appearances.

According to the court affidavit, it was around 5:49 p.m. last Saturday when the main DPS station in Fagatogo received a call from a man requesting assistance in Laulii, where Vaivai was reportedly making loud and unreasonable noises in the neighborhood.

Cops who responded to the call were able to speak to the caller, who later identified himself as the victim in this case.

According to the victim, Vaivai was yelling profanities and making loud noises before he approached him with a machete in one hand, and a rock in the other.

The court affidavit notes that while cops were speaking to the victim, they observed Vaivai running to the back of a machine shop in the village, carrying his daughter.

Investigators proceeded to apprehend Vaivai and once they had him secured, they handed his daughter over to his wife, all the while Vaivai continued to yell profane words.

Cops say they could detect a strong odor of alcohol coming from Vaivai who was transported to the police station for further questioning and later booked and held in custody for safety reasons.
