Senator files lawsuit to bar governor from spending public funds without prior Fono approval

A lawsuit was filed yesterday in the High Court of American Samoa by Sen. Velega Savali Jr. to bar the territorial government from spending public funds for next month’s Samoan Heritage Week in Hawai’i without Fono approval.

Named in the lawsuit, filed by local attorney Marshall Ashley, are Gov. Togiola Tulafono and government Treasurer Magalei Logovi’i. It says that the governor plans to spend public funds on the event and he will direct Magalei to spend public funds and the Fono has not passed any bills appropriating any funds for such a purpose.

Last week the Governor submitted for legislative approval a $50,000 appropriation bill to fund the Samoan Heritage Week in Honolulu, which Afimutasi Gus Hannemann— chairman of the organizing committee had told Samoa News is set for Aug. 8-14th at Ke’ehi Lagoon Park.

The Governor’s proposal was received by the Fono leadership the afternoon of July 14. The bill was then introduced in the Senate on July 15, while the House is waiting until lawmakers reconvene Aug. 16 to introduce the bill.

According to Velega’s complaint, the Fono has not passed a bill appropriating funds for Heritage Week and the Fono is now in recess and set to reconvene on Aug. 16.

“Thus, the Fono will not appropriate funds for the Samoan Heritage Week until after the conclusion of this event, if at all,” the complaint states.

Additionally, expenditure of public funds prior to appropriation by the Legislature would “usurp” the Fono’s power to review and approve —in advance— the expenditure of public funds.

Velega’s complaint noted that the defendants expended public funds on the event last year without receiving prior legislative approval, adding that the Legislature did appropriate funds, but only after the funds had already been spent.

(The administration requested $200,000 for last year’s event but the Fono didn’t give the final approval until after the celebration was over.)

The lawsuit cites local cases supporting the plaintiff’s position in which the court had ruled that executive branch cannot spend public funds without legislative appropriation or approval.

In the current case, the complaint says the Executive Branch “is attempting to unlawfully spend precious public funds without prior lawful authorization” from the Fono.

“This behavior is not in the best interest of the territory and cannot be tolerated,” said Velega, adding that he has standing to sue in this matter, in his capacity as a Senator.

If the defendants “are not enjoined from using the public funds without prior Legislative authorization, irreparable harm will be experienced by the Legislature through the loss of Constitutional and Statutory power and the people of American Samoa through the loss of precious public funds,” the complaint alleges.

Velega requests that the court:

•    issue a temporary restraining order to refrain defendants from spending public funds on the Heritage Week without Fono approval;

•    issue a preliminary injunction enjoining defendants from spending public funds without prior appropriation by the Fono, pending further order of the court;

•    issue a permanent injunction enjoining defendants from the conduct complained of herein;

•    award to plaintiff the costs and disbursements herein, including reasonable attorneys fees; and

•    award plaintiff such other and further relief as the court may deem proper.

Plaintiff is also seeking the court for an expedited hearing to show cause as to why a preliminary injunction should not be issued. A date was not confirmed yesterday.

There was no immediate reply yesterday afternoon from the Attorney General’s Office —who are expected to represent the defendants - over the lawsuit.

Let's see where the rest of the senators stand on this issue. Samoa News, can you please attempt to interview them one on one so we can get their positions on this issue? Do they believe they have a duty or not to uphold procedure for pre-approval before executive spending? And what do they think of Velega's lawsuit? Please publish whether or not any are willing to give you an interview. This is a festering matter of great public concern that needs to be openly talked about and Senators need to be letting their constituents know their stance ahead of any vote, so constituents can give them their input before a vote. The rest of the judges will uphold the law of the land. Instead of relying on the feds, the courts can at least administer decisions based on what was thought to be the best interst or protection of its people. Right on Sen Velega! Hope others in the House and Senate wise up and seek the same recourse instead of being frustrated by the Gov continuing to spend money he has NO authority to spend on his own...it's NOT HIS money after all, it's the PUBLIC'S. Thank you Sen. Velega. This is what should've been done a long time ago, take executive branch to court to prevent them from breaking law and misusing public funds. Velega is a hero because even if it's him alone named as plaintiff/petitioner, he's representing a voice of many of our people. Shame on governor and executive branch for requesting funds be given to HI while we have so many problems. They really dont care, am glad Velega standing up to voice objection over abuse of executive power/authority.

Just yesterday shooting occured in the Court there, use this fund to better train the police officers. Equip the officers with weapon to perform their duties when situation like yesterday happened.We all want to do better after this kind of behavior occured but why not try to prevent it from happening. What happen to deadly force training? Are the police officer train on the deadly force or the hand and arm combat training? Thank God there is a representative that is truly for the people of American Samoa that actually reside in American Samoa. I do not comprehend how the governor is so concerned about the Samoan people that live in Honolulu, when his true concern should be the people that actually live in American Samoa that elected him for governor. I like to see more people like Senator Velega who speaks up and acts against all these arrogant government leaders who does think that they are above the law. We teachers could use that $50,000 dollars to pay for our stipend that's still owed to us by the local government (DOE) because there are no funds to pay us. It's been 4 weeks going on 5 weeks now since we finished one of the many DOE teacher's workshops and we cannot get our stipend because the Budget Director saves funds for what the governor wishes to use funds on. Very disgusted teacher.

The FONO's role is to APPROVE the governor's spending before the money is spent NOT after the fact. So, now the truth is revealed that last year Mr. Togiola gifted the tax payers' money to his political friends in Hawaii without the Fono's approval. How interesting! I wonder what the United States Government will say about this type of gift giving! I think $500,000.00 is quite a large amount to be spent in Hawaii when people in Am. Samoa are suffering from lack of basic human needs.

This case is important in clarifying the powers of Executive to enforce laws and the power of the Fono to make laws, such as appropriating funds to fund public policy. Joining the Governor may be difficult because of seperation of power, so a suit to enjoin the treasurer from disbursing non-appropriated funds may be sufficient to satisfy the concern of the honorable Senator, in protecting the interest of the people in a goverment of law.
