COURT ACCEPTS PLEA AGREEMENT IN MOLESTATION CASE

 

Albert Liu Fa’apu’e will be sentenced on May 1, 2015 in connection with a sex case involving a nine-year-old girl. In a plea agreement with the government, the 29-year-old man pled guilty to sodomy and sexual abuse. In return for his guilty plea, the  government moved for the court to dismiss the remaining charges.

 

Fa’apue was accused of performing sexual acts on the young girl.

 

Defendant was facing charges of child molestation, sodomy, sexual abuse first degree and endangering the welfare of a cild.

 

According to the government’s case, the incident came to light when the victim’s mother reported the incident to the Tafuna Substation and Police Officer Iapani Tiumalu was assigned to investigate the case.

 

Court filings say that on Dec. 28, 2014 around 5a.m. the matter was reported to the police. The officers responded and spoke to the victim, who was accompanied by her mother.

 

According to the young girl, she was sleeping when she felt someone performing sex acts on her. The girl said she recognized the defendant as he lives in the neighborhood. She told police that she kicked the defendant on his stomach and scratched him and then he walked to the sink and took off running. The girl then called out to her mother.

 

Fa’apu’e told police that he had been out drinking, however when he came home he passed by the victim sleeping in her house. He said he wanted to have sex with her, and that’s when he performed the sexual acts.

 

The plea agreement was accepted, after the defendant was notified of both his and the court’s rights to abide by the plea.

 

DISMISSAL HEARING SCHEDULE FOR MARK MULIPOLA’S CASE

 

The Attorney General’s office is moving for the government’s case against Mark Mulipola to be dismissed. Defendant is scheduled to appear in court today, as he’s accused of striking his father with a machete. The defendant initially asked the court for a jury trial.

 

According to court filings, police received a call from a resident in Malaeimi, who lives near the area where the incident occurred, requesting assistance and also asking for Emergency Medical Services (EMS).

 

Court filings say the father was struck by the defendant with a machete on the head, back and his left arm, which the father put up to protect his face.

 

The father was admitted to the LBJ surgical ward, following emergency operations conducted due to the severity of his injuries.

 

According to the motion filed by ASG, it was the  doctor’s opinion that the defendant was mentally unwell at the time of the attack, and he should not be held responsible for his actions. The motion will be entertained in a hearing before Chief Justice Michael Kruse.
