Court Report

VILIAMU SENIO JAILED IN MACHETE CASE

A man accused of attacking his brother with a machete was sentenced to jail for 12 months, as part of his five-year probation. Viliamu Senio was arrested on New Year’s Eve and was charged with first degree assault, however in a plea agreement with the government, Senio pleaded guilty to second degree assault, which carries a lesser penalty.

During sentencing earlier this week, Senio asked the court for forgiveness for his actions, which led him before the court. The defendant asked the court to please give him another chance to return home and care for his wife and children. He further apologized to his brother and their family for what occurred.

Assistant Attorney Public Defender Joel Shiver asked the court to place his client on probation and further pointed out that Senio is a first time offender. Shiver said Senio shows full remorse and his incarceration has taught him a huge lesson.

Assistant Attorney General Tony Graf who’s prosecuting this matter did not object to the recommendation by the defense counsel.

Associate Justice Lyle L RIchmond, who was accompanied on the bench by Associate Judge Mamea Sala Jr, noted that this is a family issue and he believes the brothers have already ironed out their differences,

Senio was sentenced to five years in jail, however execution of sentence was suspended and he was placed on five years probation on certain conditions.

Defendant was ordered to pay a $1,000 fine, and he can be released out for work release, if the company, which Senio was working for when the incident occurred, rehires him. According to the government’s case, Senio had just returned home from a party when his brother said something that he did not like and that’s when the incident escalated.

Furthermore, the court ordered Senio not to consume alcohol, nor can he congregate with those under the influence of alcohol, or enter bars and taverns for five years, the duration of his probation.

JAMES FIATAU PLACED ON PROBATION FOR ASSAULT

A young man, who assaulted someone he was drinking with, has been placed on 12 months probation. James Fiatau was sentenced in the District Court for third degree assault earlier this week.

District Court Judge John Ward sentenced Fiatau to 12 months probation under conditions that he cannot consume alcohol for a year and he was ordered to apologize to the victim for what happened. The defendant apologized to the court for his wrongful actions and asked the court for a second chance.

According to the government’s case, during a drinking session, with another man, a verbal disagreement occurred, and Fiatau punched the defendant in the face. When police arrived at the scene they could not calm the defendant who resisted arrest.

Fiatua was ordered to pay a fine of $150 and to remain a law-abiding citizen.
