ELDEN SIOKA JAILED IN BURGLARY/SEXUALLY RELATED CASE

 

A young man who broke into a Vaitogi home and inappropriately touched a girl who was sleeping was sentenced yesterday to serve 28 months in jail, as part of his seven-year sentence.

 

During sentencing yesterday, Elden Sioka apologized to the court for his wrongdoing and pleaded with the court for a second chance to return home to care for his family, and at the same time straighten out his life.

 

Sioka stated that he is full of remorse and wants to return home as this would be the first and last time he would come before the court. Assistant Public Defender Karen Shelley told the court the defendant’s actions were not only stupid, but careless, as he was intoxicated.

 

She said that Sioka was in a drinking session when he went looking for his girl, yet he took the wrong route and ended up breaking into a family home and was caught. Both Shelley and Assistant Attorney General Tiffany Oldfield asked the court to sentence the defendant to the maximum allowable under the law.

 

Associate Justice Lyle L. Richmond said the court has taken into account the defendant’s admission of remorse, and also his young age and the fact that this is his first offense. Sioka was charged with first degree burglary, sodomy, deviate sexual assault, sexual abuse first degree and third degree assault, but in a plea deal with the government, he pled guilty to burglary second degree and deviate sexual abuse, while the government moved to dismiss the remaining charges in this matter.

 

Richmond sentenced the defendant to seven years in prison, however the execution of sentence is suspended and the defendant is placed on seven years probation under certain conditions. The defendant is fined $1,000 and must register as a sex offender. He cannot consume alcohol nor contact the victim directly or indirectly.

 

FALETOLU LOGOIPULOTU ENTERS GUILTY PLEA IN ASSAULT CASE

 

A man accused of punching another man in the face has entered into a guilty plea, during a plea agreement with the government. Faletolu Logoipulotu was charged with second degree assault and public peace disturbance.

 

Last week the defendant during his change of plea hearing admitted that he punched the victim on the face. Logoipulotu pled guilty to third degree assault which was amended from the felony assault.

 

Upon the defendant’s plea of guilt, the government moved to dismiss the PPD count. Logoitaeao told the court on Jan. 11, 2014 he punched a man in the face during a drinking session. Associate Justice Lyle L Richmond accepted the plea agreement and scheduled sentencing in this matter for May 24, 2014.
