Pago Pago, AMERICA SAMOA — The young man who violated conditions of his probation by engaging in a fight was ordered by District Court Judge, Fiti Sunia yesterday to serve a period of detention that was suspended from his previous case.

Ulima Ume appeared before Sunia yesterday morning for a pretrial conference hearing for his new case. When his case was called, his attorney, Assistant Public Defender, Ryan Anderson informed the court that they have reached an agreement with the government.

According to the plea agreement, the defendant has agreed to plead guilty to the class B misdemeanor charge of public peace disturbance, while the class A misdemeanor charge of 3rd degree assault is dismissed. With his guilty plea, Ume admits that in June of this year, he was involved in a fight with some young men from his village while he was under the influence of alcohol.

He also admitted that his actions that day violate several conditions of his 24-month probation that was handed down by the court last year; and that is, he remains a law-abiding citizen and be alcohol free.

The court granted the defendant’s guilty plea in the new case and sentenced him to a 24-month probation term.

For a previous case, for which he was placed on probation, the court revoked probation and ordered Ume to serve the 120-day detention period that was deferred by the court when he was sentenced last year.

Ume was also ordered to comply with all conditions of probation — remain a law- abiding citizen, remain alcohol and drug free, and pay a fine of $100
