Man arrested for PPD in 2017 — finally takes his day in court

Pago Pago, AMERICAN SAMOA — A man who was arrested and charged for public peace disturbance stemming from an incident that occurred in August 2017 has been sentenced to 9 months probation.

Fogavini Ese appeared in District Court Thrusday morning for a pretrial conference where he pled guilty to public peace disturbance, a class B misdemeanor.

According to information revealed in court, an intoxicated Ese was disturbing the peace at the Tafuna International Airport — in the parking lot and also the restroom area.

He also admitted to publicly urinating on airport property.

Prosecutor Assistant Attorney General Jason Mitchell and defense attorney Assistant Public Defender Anna Whiles had recommended probation. Mitchell however noted that Ese was found guilty of public peace disturbance in another case back in 2009.

Judge Elvis P. Patea sentenced Ese to 9 months probation and he is up for a probation review on May 31. Ese is to attend and successfully complete an alcohol-counseling program and pay a $100 fine within 30 days.
