Pago Pago, AMERICAN SAMOA — The Probation Office is asking the High Court for an Order to Show Cause (OSC) hearing against Samuelu Sofara, on the allegation that he violated conditions of his probation, after he tested positive for methamphetamine and marijuana.

Sofara — while on probation — was arrested two months ago with two other co-defendants on the allegations that they broke into Kim’s Shop.

Sofara and his two co-defendants appeared in High Court last month for arraignment, after their cases were bound over from District Court.

According to a report from Probation, a probation officer administered a random urinalysis test on the defendant when he appeared in District Court for his initial appearance on Apr. 23rd, and the test was positive for methamphetamine.

Sofara admitted to Probation that he smoked meth with his two friends at his home in Leone two nights before he appeared in court.

In 2016, Sofara pled guilty to drug possession following his arrest at a bus stop in Tafuna, after an eyewitness informed police that the defendant was selling marijuana joints to other people.

For that case, Sofara was sentenced to 5 years probation, under the condition that he serve 20 months at TCF. He was also ordered to remain alcohol and drug free.

FALETAU MOLESI

A bus driver accused of violating local drug laws has entered into a plea agreement with the government.

Faletau Molesi, 52, appeared in court last week for a Change of Plea hearing, where Assistant Public Defender Rob McNeill represented him, while prosecuting was Assistant Attorney General Laura Garvey.

Molesi was initially charged with unlawful possession of methamphetamine; and unlawful possession of methamphetamine with the intent to distribute. But under a plea agreement with the government, he pled guilty to a lesser, amended charge. The remaining charge was dismissed.

Molesi admits that on May 29, 2018 he unlawfully possessed 4 glass pipes containing meth.

According to notes of the plea agreement, a passenger alerted police after he witnessed the defendant selling methamphetamine to two men inside a bus at a store parking lot in Nu’uuli on the morning of the incident.

During a body search, officers discovered 4 glass pipes containing meth inside the right pocket of the defendant’s pants. The defendant told police he had 6 glass pipes with him, but he sold two of them to two men for $50 each.

Molesi will be sentenced July 12th.
