Pago Pago, AMERICAN SAMOA — Acting Associate Justice Elvis P. Patea has granted a motion from Acting Public Defender Kate Hannaher to continue to another date, her client’s Order To Show Cause (OSC) hearing which was scheduled for yesterday.

. who is out on a $5,000 surety bond, appeared in High Court yesterday morning for his OSC hearing.

According to court records, Siaumau Jr. has two OSC hearings, and they came after the government felt the defendant violated conditions of his release from a previous case that was filed last year.

When Siaumau Jr.’s case was called in court yesterday, Hannaher asked for a continuance for both OSC hearings, saying the cases in District Court and High Court are still pending.

Prosecutor Christy Dunn did not oppose the defense’s motion.

Judge Patea on the other hand wanted to know the charges the defendant is being accused of in both cases.

According to Dunn, the defendant is charged with public peace disturbance in the District Court; and felony assault along with other misdemeanor charges for his case in High Court.

Patea granted the motion and set a hearing for Aug. 30.

"If both of these matters are resolved, somebody has to move forward these cases, otherwise we’ll meet again in August,” Patea told both attorneys.
