A 19-year-old appears for probation revocation

Pago Pago, AMERICAN SAMOA — A 19-year-old girl who was convicted of stealing in High Court two months ago was back in court — this time District Court — for failure to comply with conditions of her 24 months probation.

Caroline Purcell appeared before Judge Fiti Sunia last Friday for her Probation Revocation hearing.

She was representing by Assistant Public Defender Ryan Anderson while Assistant Attorney General Bianca Lherisson appeared on behalf of the government.

When Purcell’s case was called, her attorney, Mr. Anderson informed the court that his client admitted to the violation of her probation.

According to the court, Purcell is on 24 months probation after she was convicted for two separate matters. In her first case, she was placed on probation for 24 months in Oct. 2017, after she was convicted of underage drinking and public peace disturbance. Conditions of her probation include being a law-abiding citizen.

In her second case, she was also placed on probation for 24 months in Dec. 2017 after she was convicted of public peace disturbance. Conditions of her probation again included being a law-abiding citizen.

However in April of this year, Purcell was convicted by the High Court for felony stealing and was placed on probation for 5 years under certain conditions. She was sentenced by the High Court to a period of detention of 4 months.

And for that reason, Judge Sunia found Purcell in violation of her 24 months probation, and ordered that her probation be revoked and she must serve the period of detention of 44 days that was suspended by the court when she was sentenced last year.

However, she will be credited for the time she has already served in TCF for her High Court matter, which was 4 months, which means Purcell will not have to serve any more time.
