Federal court grants release of garnished funds to Marisco

A federal judge in Honolulu has signed off on a “stipulation to release all funds deposited” with the federal court registry to Hawai’i based shipyard Marisco Ltd., totaling more than $800,000.

 

The federal court last year ordered this amount garnished from the American Samoa Government general fund account, held at the Bank of Hawai’i to repay outstanding invoices due to Marisco, who performed work for ASG.

 

The funds were then deposited into the federal court registry while ASG appealed to the Ninth Circuit of Appeals Court in San Francisco two separate rulings by the lower court. Earlier this week, the parties in the appeals reached a Settlement Agreement and stipulated to dismiss with prejudice the appeals, which also cover ASG’s two separate civil action suits pending against BoH at the HIgh Court of American Samoa, said court records.

 

The parties then filed Wednesday with the federal court in Honolulu a joint stipulation to release the garnished funds and it was signed the following day by U.S. District Court Judge Leslie E. Kobayashi.

 

“...to implement the [Settlement] Agreement, the parties respectfully submit this stipulation to the Court requesting that all interpleaded funds - $824,071.15 -  on deposit with the Clerk be released and paid forthwith to plaintiff Marisco, Ltd., without interest,” according to court documents.

 

Releasing the money to Marisco now closes this case once and for all, following a promise from Gov. Lolo Matalasi Moliga that his administration will not pursue this matter and will make sure that it pays what’s owed by the government.
