Father jailed for incest in Samoa

A man who threatened to kill his daughter if she spoke to anyone about his having sex with her, was sentenced to four years and nine months in Tafaigata Prison in the Supreme Court.His name cannot be published as a result of the nature of the offence but he is a father of seven children including the victim in the matter.The decision was handed down by His Honour Chief Justice Patu Tiava’asu’e Falefatu Sapolu during sentencing yesterday afternoon.The accused continues to deny the charges against him.He was represented in court by defence counsel Lani Tuioti.Prosecuting lawyer was Ofisa Tagaloa.He was on trial for 14 substituted charges of having sexual intercourse with a female under the age of 21 years living with him as a member of his family and another nine charges of sexual violation by having sexual connection with a dependent family member under the age of 21 years.He was found guilty of the 9 charges of sexual violation by having sexual connection with a dependent family member under the age of 21 years.The maximum penalty of every offence is 14 years in prison, said His Honour.The victim in the matter was 17 years old at the time of the offending. The accused was 41 years old then.The offences occurred on nine separate occasions over a period of 10 months between May 2013 and February 2014 where he had sexual intercourse with her.All incidences occurred at his family home either late at night when other family members were all asleep, or during the day when he was alone with his daughter.The victim also received beatings from him if he caught her speaking to boys from school or from the village.His Honour said that in the victims oral testimony, the accused would come to her bed and have sexual intercourse with her while her little brother and mother were asleep.“And sometimes during the daytime when they were alone they would have sexual intercourse.”He said that on each of these occasions the accused “threatened the victim not to tell anyone or threatened to kill her if she told anyone what he was doing to her”.“In the victims oral testimony, the accused was always angry and jealous when she talked with boys from her school or the village.”
