Fagaitua teacher charged with rape, sexual assault of 16yr old student

A 48-year-old Fagaitua High School music teacher from Lauli’i has been arrested and charged on allegations of having a sexual relationship with his female student at school. Rose ‘Lose’ Auva’a is being held on bail of $35,000 on charges of Rape, Sexual Assault, Sodomy, Deviate Sexual Assault and Sexual Abuse first degree.

 

The defendant was arrested last week Thursday on a Public Peace Disturbance charge however when he was taken into custody, his daughter informed police as to why her father allegedly committed the PPD at their residence.

 

According to the government’s case on Apr. 4, 2014 the defendant’s daughter reported a PPD to the Fagaitua SubStation. Samoa News understands the father had allegedly gone after his daughter with a machete. It’s alleged the machete incident occurred when the defendant’s daughter approached her father about an alleged relationship with a student from school.

 

The daughter told police that she had observed her father using the computer to send Facebook messages late at night. She accessed her father’s Facebook account and found a number of chat messages between defendant and his 16-year-old student.

 

The daughter showed police the messages, where it contained sexual content and references to sexual acts, which defendant and the female student performed on one another. Court filings say that police located the student and spoke with her. The student stated that her relationship with the defendant started on Feb. 12, 2014 when she asked her teacher to help practice a song.

 

“At practice the defendant locked the classroom doors and kissed victim on her mouth,” say court documents, which also allege that the day after the first encounter the defendant started talking to his student on Facebook and the communication on Facebook continued through Apr. 7, 2014.

 

It’s alleged that another sexual incident occurred on Mar. 14, 2014 inside the Fagaitua High School classroom. The female student recalled that one Friday night the defendant sent a message on the victim’s Facebook account telling her to meet with him at his classroom and she did. Allegedly they had sexual intercourse, and at that time the teacher told his student not to tell anyone about their relationship.

 

Court filings say that on Apr. 1, 2014 Auva’a sent the victim a message asking her to go to school where the defendant picked up the victim and they drove to Aoa. “During the ride, the defendant informed the victim that his wife had found out about the relationship.” It’s alleged that on the way back, the car pulled over in Auto where the victim and defendant went to the back seat and had sex.

 

The victim and her parents showed the Facebook messages to the police where it was all printed out and the defendant sent a message on Apr. 2, 2014 telling the victim that his account has been hacked and told the victim not to contact him anymore and to delete all records of conversations between them, say court filings.

 

According to the court filings, the rape charge is a class B felony and it carries a jail term from five to 15 years, while sexual assault, sodomy and deviate sexual assault are class C felonies which are punishable by up to seven years in jail. The sexual abuse charge is a class D felony which carries a sentence of up to five years in jail.
