Christmas Eve — not a happy time for a man who assaults wife

A man has been charged with allegedly breaking into his with wife’s residence and assaulting her. Court filings say that the man is separated from his wife.

 

Samoa News is withholding the name of the defendant in the interest of protecting the identity of the victim.

 

Bail for defendant is set at $10,000 and he’s facing first degree burglary which is class B felony punishable up from five to 15 years in jail, two counts of third degree assault, where each count is a class A misdemeanor punishable up to one year in jail, a fine of up to $1,000 or both.

 

The man was arraigned in the High Court Wednesday morning where he pleaded not guilty to the charges against him.

 

According to the government’s case, on December 18, 2014 after midnight police received a call from the woman that defendant had broken into her house. Its alleged that the defendant entered into his wife’s bedroom through the side screen window and the woman screamed when she saw him. Its alleged the defendant then grabbed the victim by the hair and pulled it.

 

The victim’s male cousin entered the room to help the woman when the defendant punched the cousin several times and during the assault the bed broke. Court filings say when the police arrived at the scene, the defendant was inside the house, and was swearing. Police detected a strong oder of alcohol on the defendant.

 

Court filings say the defendant said that he went into the house because he saw the victim and a male sleeping in the same bed.

 

Also noted in the fillings, was that as the police officers took the defendant into custody, he was screaming threats — the report does not note if he was screaming at the defendant or the police.

 

The defendant is represented by the public defender’s office while prosecuting is Assistant Attorney General Tiffany Oldfield.
