A family whose three-year-old son was put in a police cell with his father a fortnight ago is suing the Samoan Government.
Siaosi Tiavaasue was taken into custody by police after being caught driving an unregistered vehicle for the second time.
His son was with him but because no one was available to pick him up from the police station, he was put behind bars with his father.
His mother Tinei Tiavaasue said she was very upset when she received her husband's call.
"No one was here at home. It was just me and my baby. I didn't know what to do. It was shocking and sad," she said.
